The following General Terms of Use govern all services provided by Today Load to users of this Website or site, whether acting as a consignor, consignee, vehicle owner, transport contractor, or in any other capacity. Today Load provides a platform that enables consignors, consignees, vehicle owners, transport contractors, and agents to connect, compare, place orders, or enter into contracts or transactions, facilitating seamless transportation of goods from one location to another. Any deviations from these terms are valid only if confirmed in writing. These General Terms of Use also apply to all additional or revised services.

Obligations of Users

The users agree not to:

• Use the services to gain unauthorized access to systems, networks, or data.
• Violate any applicable laws, regulations, or legal requirements.
• Share content you do not have rights to, or that infringes intellectual property rights.
• Distribute viruses, malicious code, files, or programs that disrupt or damage the services or affect other users.
• Interfere with or disrupt the services, servers, systems, or connected networks in any manner.

Privacy & Confidentiality

The Today Load Website shall not be liable under any circumstances for direct, indirect, special, consequential, or other damages resulting from the use of this Website or any information or images contained herein, including, without limitation, lost profits, business interruptions, or loss of programs or other data. Users are required to treat any non-public data or information as confidential and to use it solely for its intended purpose.

The confidentiality obligation does not extend to data or information that must be disclosed to third parties, including public authorities, due to legal requirements. The other party must be notified of such disclosure obligation without delay.

Limits on Liability and Warranties

• Shall not be responsible for pricing or payment terms of contracts between vehicle owners and consignors/consignees, transport contractors, or agents using this platform.
• Shall not be liable for disputes between consignors, consignees, vehicle owners, or drivers regarding quantity, quality, packing, or assembly of goods transported through this app.
• Shall be harmless from any claims, losses, damages, costs, or expenses, including legal fees, arising from use or misuse of the services, violations of these Terms, or breaches of representations and warranties.
• Shall not be liable for late or early pickups/deliveries, waiting charges, or if users arrange freight without pickup/delivery services, in which case users are responsible for delivering shipments to designated points.
• Shall not be responsible for the goods or services procured using this app. Users should evaluate goods, services, and terms before availing them.
• Shall not be liable for natural loss, damage, or deterioration of goods due to pilferage, theft, accidents, natural calamities, or similar causes.
• Shall not be liable for the conduct of vehicle drivers. Users may report complaints against drivers hired through this platform.
• Shall not be liable for the performance of services previously agreed upon by user parties.
• May penalize the load owner by charging a cancellation fee if they refuse to load the shipment when the vehicle owner arrives, after booking and paying the advance.
• May request feedback from users regarding vehicles they have used through the platform.
• Shall withhold a user’s money in case of fraudulent or malicious behavior on the platform.
• May contact users if money is credited to their account due to a technical glitch. Users must return the exact amount within ten days, failing which Today Load may take legal action.

The user of the Website acknowledges and agrees that they are responsible for verifying the contents, packing, sealing, addressing, labeling, handling of goods, and all related shipping or carriage instructions.

Intellectual Property Rights

The Today Load name, logo, and other trademarks, service marks, graphics, and logos used in connection with the Website are the trademarks of Today Load. Other trademarks, service marks, graphics, and logos appearing in the Website are the property of their respective owners (collectively, “Third Party Trademarks”). Neither the Today Load trademarks nor the Third Party Trademarks may be copied, imitated, or used, in whole or in part, without the prior written consent of the respective trademark holder. The Website and all content featured therein are protected by copyright, trademark, patent, and other intellectual property and proprietary rights.

Indemnity and limitation of liability

If any loss or damage arises to Today Load due to your failure to provide accurate information, or due to your actions on our platform that violate applicable Indian law, you agree to indemnify and hold us harmless from such loss or damage.

You agree to be bound by these Terms of Use and shall fully indemnify Today Load in the event of any breach of these Terms.

You acknowledge that Today Load is not liable for any illegal or offensive actions of third parties on the platform. Additionally, we are not responsible for any delays or inaccuracies in information provided by third parties.

Any transaction or interaction between you and a third party on or through our platform—including delivery of goods or services, payments, and terms—occurs solely between you and the third party. Today Load shall not be liable for any losses or damages arising from such dealings.

Governing Law & Jurisdiction

Except as otherwise stated in these Terms, they shall be governed by the laws of India. Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the Indian courts.

If any provision or part of a provision of these Website Terms is held by a court or competent authority to be invalid, unenforceable, or illegal, that provision shall be severed, and the remaining provisions shall continue in full force and effect to the maximum extent permitted by law. All rights remain reserved to the trademark holder and its licensors.

Any dispute, conflict, claim, or controversy arising out of or in connection with the Services or these Terms, including disputes regarding their validity, interpretation, or enforceability (collectively, a “Dispute”), shall first be submitted to mandatory mediation under Indian law.

If the Dispute is not resolved within sixty (60) days of initiating mediation, it may be referred to and shall be exclusively resolved by arbitration under the Arbitration and Conciliation Act, 1996 (“Act”). The arbitration shall be conducted by a single arbitrator appointed by Today Load.

The venue for both mediation and arbitration shall be Kutch, Gujarat, India. The proceedings shall be conducted in English. If a party does not speak English, proceedings may be conducted in both English and the party’s native language.

All aspects of the mediation and arbitration, including documents, briefs, correspondence, orders, and awards, shall remain strictly confidential and shall not be disclosed to any third party without written consent, except when disclosure is necessary to conduct the proceedings and the third party agrees in writing to maintain confidentiality.

Updates to Terms of Use

We may update or modify the Terms of Use from time to time. Any changes will take effect upon posting the revised Terms on the platform, without separate notice to you. Users are encouraged to review the Terms regularly to stay informed of any updates.

Miscellaneous
